Texas Expungements & Nondisclosures

The terminology itself can be confusing when it comes to clarifying a person’s history. Most people know what it means to “seal” their records. But in Texas, it’s called nondisclosure. To seal criminal convictions in Texas, a person must receive a nondisclosure order from a judge. Expunction is a word used in our law regarding the complete erasure of an arrest from an individual’s record. To destroy the arrest records, the person must also obtain an expungement order from a judge.


Can I Clear My Criminal Record?

Whether the arrest can be cleared or erased in your case depends on how the case is ultimately resolved. To be eligible, a person’s case must be directly dismissed, found not guilty at trial, or be a Class C offense (or ticket) dismissed on deferred adjudication, never charged (provided that a certain waiting period has expired), pardoned, or the public prosecutor recommends expungement. If your case is expunged, you can legally deny you were arrested if asked in the future under Texas law.

If your case does not fall into any of the qualifying circumstances listed above, you are not eligible for expungement. However, you may still be able to seal your record through a nondisclosure.
